Dude, that's the classical thing NOT TO DO! At this point he's doing you a favor offering you anything. The second he gets a little educated and realizes all he has to do is send you a CD letter, you're pretty much obligated to hand the name over. There are exceptions of course, but based on what you posted, I think you made a mistake. You knew it was their trademark and offered to sell it to them

I know...i wasn't going anywhere with the name. So i figured i would do it now instead of later. I know it's what NOT to do. But any advice from here on out? ;)

What - was it a cup of coffee or something like that.

At this point I may say I would sell it to him for my acquisition costs plus the "product"...did you get it on a drop? If you got it for $60 I would come back with something around 2-3x that...and just move on.

I try not to mess with any blatent tm's though (or any tm's for that matter) as they may just want to use you as an example.

Something very similar to that Onward a bit more expensive than a cup of coffee.
Worth anywhere between 5-8$

I think my goal was try to get a quick deal. I have yet to respond. I probably won't.

So...I did something today that i thought i would never do.

I went ahead and approached an end user for a domain that i know was Trademarked. He already owns the .com. I figured i would give it a try and see if i could sell him another TLD extension.

There is not that much risk for me...other than basically handing the domain over. So i thought...well ..let's give it a shot.

After my email today...he shortly replied after. Within 5 minutes. Something i never expect from anyone. His reply? dun dun dun...

"How much were you thinking? How about for the exchange of the domain name, I would be happy to buy you a "product" on us?"

I have edited the above portion just because i do not want it indexed.
The "product" was edited. Unfortunately the product is very cheap. Less than the value of what i paid for registration.

So i need some feedback. He stumped me...if i reply with what i really want...he can just come after me.

you simply need a good spankie to solidify the lesson you taught yourself...
and just eMail him for his push details and be done... sounds like he knows
he can just TAKE it from you... and just because you don't want something indexed...
doesn't mean he won't BLOG about you and use your real name etc...

hope it all works out for you...

and in my dream world he'd offer you $100.

but hey... Im awake... so I doubt that will happen...

I must admit this was far from a lesson. I know what i am doing...but i picked the domain up less than a month ago. I figured i could get a quick sale if not...lose $10. I will survive. But the thing is...he can choose to reject my offer. (I am about to send him an email now). But..if he wants to play hard ball...so can I :)


NEW INFO : Just sent email about my asking price. I will let you all know what happens :)

So you think "There is not that much risk for me".
The other party has more options available.
They could start a UDRP or even sue you, and they would win easily.
Either way this would result in your name tarnished forever on the Internet. Reputation is priceless, in particular in this business.

Also, if they already have the .com, do they really care or need about the other extension you are trying to pitch to them ?
I think you are not only taking big chances, you are wasting your time.

I'm not really worried about that sdsinc. It's not like a totally obvious trademark. There was no harm in contacting end user. This is just a small franchise.

Not sure why everyone is so negative, most of these UDRP's occur because the seller is pretty unreasonable. I am being honest and fair. To each their own though.
