Bad taste from Sedo offer

For only the second time since I started in 2008, someone has run out on an offer I accepted on Sedo. This leaves a bad taste not just because I feel I had entered a contract, but because I'm concerned as to why someone would do such a thing.

I found myself feeling sorry for this person. Could the offer have been made in error for the wrong name? Could a finger have slipped and entered the wrong amount? But what puzzled me is why, if one of these was the case, the potential buyer didn't look the name in WhoIs and contact me directly to explain what had happened. I think that this is what I would do if such circumstances were ever to arise, although I tend to obsess about being careful, so it's unlikely.

I thought that the offerer might be someone inexperienced, but then Sedo sent me the name and I discovered that he has a fair number of domains, at least one of which (a 4L.com) he seems to have bought here, although I don't know if he's a member. So I'm even more puzzled now. What could be the motivation for making an offer you don't intend to honour? Has anyone here ever done this, and how and why?

People change their mind all the time. I can't tell you how many times we are about to close on a transaction and emails go unanswered. Cold feet. Don't dwell on it. Better to just pick up and move on. There are enough good buyers and sellers out there. Why not post the name and your expected price and maybe someone will even buy it from you tonight from DNF!!

I know it's no big deal (no pun intended). But the psychology still interests me.

Although, when someone makes an offer and I accept it, I consider the deal to be closed rather than 'about to close.' Or am I just old-fashioned?

Personally I would post the name of the person as you already have it.

You know Sedo won't do anything so "Name and Shame", might help out others in the future.

When a transfer is cancelled by Sedo (in this case because of nonpayment by the buyer), they send you a message saying that the buyer's name is now in the Transfer Documents for you to find. With the name you are informed that the contract is under Massachusetts' law (I'm in Ireland).

To set out to sue is no guarantee of success, no matter how clear-cut the case might appear to be.

If someone commits a crime against you, you still have to go to court to get him convicted, no matter that he may have been caught red-handed. I imagine that is the same in a civil case for breach of contract, otherwise there would be no point in bringing it to law in the first place.

That is why I don't think it's fair or right to 'name and shame' here. If this were an appropriate path to take, the responsibility would surely be Sedo's, who could maintain a list of such defaulters for users of their site.

The fact is that Sedo won't lose by the default. They will still get their commission, according to what I read on the page giving the buyer's name - and within five days or else. Presumably Sedo can afford the time and expense to follow up on this demand. It's a shame they don't also feel a responsibility to do it on behalf of their site users.

Put him in a spot . Name and shame is your best bet. It will also warn other sedo users about this person.

Always make the contact info of deadbeats public, usually on dnforum. Their indexed name will soon make them think twice before acting again in the same manner.
