Doubt it - eBay probably has a list of terms and conditions longer than the bible and an unabridged dictionary combined.

The most you'll probabaly get, and only with a court order, is the IP address of the scammer but if they're good, they spoof.

I can't imagine hiring a VB programmer or doing any outsourcing through EBay, and didn't know they even did that. There are loads of services which provide equity and arbitration.

MIR, that's terrible. You could have hired one here perhaps? No recourse in your current purchasing channel so that you're going to recoup $300. Sucks.

Actually, eBay is vulnerable in many US states and a lot of foreign countries.
An important issues was raised in the past: eBay is a broker COLLECTING fees. In every industry brokers are liable for DEFECTS & misinformation.

Paypal has to be used with most items now. I suppose PP will not cover the loss with their buyer protection because it's considered a service?
You have a much bigger chance of getting your money back when you pay with a credit card, with or w/o help from PP.

As for having enough evidence for a class action, there is no way to know without consulting a lawyer.
Any claim or suit may have to be filed in the county and state as provided for in the TOS.

You might rattle this person's cage and get your payment by filing charges with their local police department.

That's funny you mention a class action lawsuit against ebay. I have a different reason though.

I actually registered a domain name for this purpose. If you haven't realized it yet, eBay is shaving your auction time you pay for. I don't want to steal the thunder from this thread with the details unless the OP request otherwise, let it be know that eBay are crooks for many different reasons.

One thing to understand about the multi accounting with ebay is practiced by the majority of honest business who like to brand different goods, generally tangible. I have worked a booth at a couple ebay live conventions in my past and have met many power, platinum and titanium sellers. Most had more then one account selling different goods.

For eBy it is figuring out how to crack down with out hurting your bread and butter clients.

Something should be done, but what can eBay do?

As for being ripped off, you can seek legal assistance. eBay will give you the users contact info, hope it is real. You can contact the local police of the seller and start a report and go from there.

As well if you have the time to spend you can request the IP address records of the seller, and or subpoena them which will also help you figure out the location. Someone correct me if I am wrong, but wouldn't this be a form of wire fraud?

I know of countless lawsuits levied against ebay and ebay has won.

The courts of California are very pro-ebay.

If Tiffany's of Tiffany and Company can not win forcing ebay to stop selling fake and forged Tiffany items, then good luck.

Scams, scammers and schemes are part of doing business on ebay. The evolve quicker than imaginable.

Cant disagree with you, logically how will it hold up in court. It needs a very creative argument and facts to back the argument up.

Do you list on eBay and if so how often a month?

Now if you do list items for sale, how long are your auctions, 1 day, 3 day, 7 day...?

Now if you have answered the above, then please answer this.

Should your auction clock start ticking the moment you click the list button, or the moment your listing is indexed and searchable?


If you were not aware it can take up to 5 hours +/- before your listing is really live on ebay and showing up in the results. Meaning no one knows you listing is live until it shows up in the category results. If no one can see your listing how can they bid, and why should you loose the time you paid for?


Which means if you launch a 1 day listing you may only be really getting a 19 hour listing in actual time and so one depending on the auction duration you choose.


I would call it shaving
