I like the description of Register fly, as "this shoddy outfit."

In fact, ICANN, which collects a fee for every domain sold through its accredited registrars, did not give notice of termination of ICANN's accreditation of RegisterFly until the day AFTER attorney Dummit served ICANN with this class action lawsuit.

Wow - how long could it have gone on for?

Just as amazing as Icann's long delay in doing much is the fact the registerfly website is still up and running today (I just checked) and still accepting online orders from the many average folks who are not familiar with this.

What I find so interesting is that in business over many yrs if a consumer somehow (wrongly) assumed I had incorrctly charged them (always incorrect but merely a cust error), or perhaps (wrongly) claimed the item they ordered was not as exactly advertised or wrongly marketed somehow they would instantly write to the state Attorney General and/or BBB, even other govt agencies, and sometimes I would get a phone call or letter asking about the issue. It only happened rarely with my business but on the big scale of regfly it should have happened thousands of times.

Yet, with I assume tens of thousands of consumers clearly defrauded and millions of dollars, and livelihoods lost, (including myself who was cheated $ on a failed renewal in 06 but they kept my money) nothing has apparently been done as far as legal action goes by either the State AG's in FL and NJ, or the Dept of Justice or even FBI (clearly interstate mail fraud and conspiracy)! I find that simply amazing! In fact, I believe even their credit card merchant processor bank is still taking CC orders which is just as incredible.

Usually attorneys will sue everyone with any involvement (especially those with the deepest pockets) then let the court sort it out.

How many assets does Rfly own as a corporate entity? Getting to the principals' personals assets means piercing the corporate veil and demonstrating they co-mingled assets.

And how likely would it be that Kevin, etal, if he were to be on the losing end of a suit would simply declare bankruptcy?

This will be verrrrry interesting...

Why has registerfly not been shut down yet? Why are they still accepting payments and registration?! There ARE some people that have yet to be informed about this situation, and im sure they are still receiveing orders daily!

My 12 year nephew can do a better job running ICann then the idiots running it now..

This made my day. Killing 2 vultures with one giant rock. Then again, I shudder when I think what would happen should ICANN come under financial responsibiltiy for their actions, and lost money over this. Will the domain price be increased to .50 cents per registration. Or more?

I used to hold back when all the 'registerfly is evil' type threads would appear here at DNF, participating only minimally and infrequently, but it felt good to discover that I was far from alone in knowing what had been going on, besides the guy I had also discovered publishing stopunifiednames.com. Unfortunately the right thing doesn't always happen in this age, so this meltdown and implosion was a particularly welcome headline.

When you put it all together, however, it seems that much more may need to be done besides civil action. Given the amount of customers involved with this 'business,' my own experience and the statements of others, I would not be surprised and personally consider it likely that credit card and other payment fraud in the hundreds of thousands of dollars per year has taken place, possibly millions - even fraud coded into the server-side processing that was in place.

I agree. I think others beyond RegisterFly and ICANN should be held accountable.
