Dealing with Enquiry from Company Over LLL.com

I have a LLL.com and have received an email from a company named (for example) "LLL Tables". They sell tables (for example) in the United States through a couple of retail stores. They have a trademark over "LLL Tables" but NOT "LLL".

They want to know if the domain is for sale and for what price. The LLL I have stands for several medical acronyms and I have a developed website based on this.

Nonetheless, I am still slightly paranoid they may try to say bad faith or something if I respond, even though they don't seem to have a trademark over my exact LLL combination alone.

How would you suggest dealing with them going forward?

First of all let them make you an offer then SAVE the email, hit back with a high counter offer and then if they try and hit you with a WIPO or UDRP........you hit them with a case of "Reverse Hijacking"

Case Closed in your favour...........end of story :)

Basically because they have tried to purchase the domain from you.........

They have already contacted you regarding the domain and it's sale...it's open game now dude..if they then tried to take it away it would be considered retaliation and entrapment imo...if they had sent you a C&D letter instead of an email expressing interest in buying it then be paranoid...their contact pretty much opens up the negotiation channels.

Also, if the domain predates their TM which I will assume it does then you really are in a strong position to make a clean end-user deal. This is why we have LLL.com domains.

find some examples of LLL.com sales with similar letters to yours to get an idea of price. shouldn't be hard looking in dnjournal's sales history. also agree to let them get the ball rolling with stating the first price/offer.

Tell them it's slated for development for (insert project scope) and state that you'd be willing to part with it for the right price. Avoid parking it as it might one day display ads about tables or furniture.

Agree with Acro. Cover all your bases. Don't assume anything will go in your favor in a UDRP. It all comes down to who the panelist would be and how clueful they are. I remember a couple years ago member "mohno" lost a couple of really really bad udrp decisions.

A key is to make sure you document in the email what your legitimate use of the domain is going to be. Defending yourself in UDRP has more to do with you proving your rights to the domain as opposed to disproving theirs.

If you're lucky hopefully you won't have to deal with any of that nonsense and they'll just buy it for a crapload of money.
