DELL, the computer technology company filed a UDRP with the National Arbitration Forum seeking control of the domain names DellStoreJaipur.com and DellStoreInJaipur.com
The complaint was filed on October 31, 2014.
According to whois records, the domain names were first registered in September,2013.
DELL owns many trademark registrations for the "DELL" mark all over the world. Therefore,it is more than obvious that the disputed domain names are confusingly similar with its trademark.
Moreover,the company contended in the complaint that the respondent has no rights or legitimate interests in the disputed domain names and that the respondent registered and used the disputed domain names in bad faith.
One of the key points of this complaint was when DELL managed to demonstrate that " Respondent’s use of the <dellstorejaipur.com> and <dellstoreinjaipur.com> domain names to promote products from Complainant’s competitors disrupts Complainant’s own business."
DELL managed to establish all three elements required under the ICANN Policy and the Panel ordered the disputed domain names to be transferred from the respondent to the complainant.
