I bought a .com domain name with a VERY well known company in the name. It's long but its the entire business name.

I am a newbie and it could have been a big no-no or I could have bought it from someone who gave it up from here for that reason.

Just trying to find out where I should go with it.

Thanks!

I should add that when I type the name in google it brings up 4,530,000 results.

It's hard to give you a straight answer since we don't know the domain name, but.. it dosen't sound like a situation you want to be in.

Check here to see if the business name you are talking about is trademarked. If so, lose it immediately.

Naturally "Shell" is registered. I checked the domain name and it was not trademarked.
Still dump?
Thanks for the advice!

TM violations are based on usage, not domains.

You mentioned "Shell" - this is can be a generic term.

Now, if you use it to sell sea shells, shellfish (clams, lobsters), etc.. you might be OK. but once you touch into anything to do with gas, oil, energy, etc. then you might be on thin ice in 90 degree weather. Also be careful if it's "MagicShell" which is a popular ice cream topping (like chocolate syrup that hardens when you pour it on ice cream) - chocolate shell might get you in trouble, too, because of this.

A distinctive domain like coca-cola.whatever can still land you in trouble even if you do nothing with it ;)

What else can actually happen to you besides losing the domain. If you just own it and don't park it?

It is nicely explained here: http://uspto.gov/
We have Q8.MS up since years.
No problem - It is not oil related - Neither one of the other registered classes.
Check here: http://www.wipo.int/ipdl/en/search/madrid/search-struct.jsp
Type shell in the mark box ...

most words are often trademarked, and more more than several people. Relax, and use the domain as long as you are not infringing on someone else's tradename. D0 your research. Dont use any ppc pages in the mean time.

Ok, what if I have a name that is an obvious trademark like: cocacola.org , can I use it to make a site to tribute coca cola? like have a bulletin board and have people post pictures about it? In a positive way. what do you think?

coca cola is a coined term...not only a tm...To use it would be a losing battle.

My point is that even if you have a coca cola fan site, you might pull it off, but if they want you to stop, and turn over the
domain, you are sol. Are you doing this for the money? what is your motivation? if it is ppc, you will get shut down., probably, eventually, maybe never...Is it really worth the hassle? In canada, you cannot get sued for damages at cdrp, but at wipo, you can also
get sued for damages. be careful.

well my motivation would not be ppc, It would be to link to existing business's that i do have. I don't mind if they shut it down and take the name I just don't want to lose any money or get sued for it.

Stupid question, but I'm sort of in the opposite situation here.
T
here's a well known local business that is using lastname+service as their business name (ex: SmithGarage) and I bought the family name (smith.com)…I'm in the clear right?
