[FONT=&quot]Facebook is starting to be quite popular in France already, even though the interface is just in English. Until today Facebook.fr was even redirecting to Facebook.com and one would have assumed that the company had acquired the fr URL until the roll out happen

'facebook' is a generic word, been around long before facebook.com - and the .com site is using it for the principal meaning of the word, so how can it be a solid TM? It's like owning Tickets.com and selling tickets to events, how could you stop tickets.net from doing the same?

Facebook is a powerful trademark now, and regarding the 'face-book.com' dispute... I'm pretty sure that the .fr will end the same way.

Facebook’s complaint was based on three points:

* “the domain name is identical or confusingly similar to the Complainant’s FACEBOOK Marks”
* “the Respondent has no rights or legitimate interests in respect of the domain name” with no registered trade marks, no goods or services provided and “simply uses the website at “www.face-book.com” as a portal site, listing advertisements and links to other commercial websites that offer goods and services highly similar to those of the Complainant”
* “the domain name was registered and is being used in bad faith” and intended to free ride on Facebook’s name.

Lycos : is an ancient city name at Turkey
Philadelphia : is an ancient city name at Turkey

Nowadays Lycos.com tried to take control of Lycos.com.tr to operate in Turkey, but the name Lycos has been already TM by a tea producer, and use Lycos.com.tr for this purpose.-also different registration class-

So court did not canceled domain name and tea producer continues to use it.

I read on news that tea producer also is not going to sell its brand address to Lycos.

If facebook.fr has already been used for a TM then nothing to do for facebook.com .
