Hello recently i met a guy who was looking for a partner in a new site www.sigrent.com .
The initial price was $1,000 usd each for an advertising launch on many sites including business.com .
After payment went through i never heard from him again no e-mails, replies to his pm's even though it was reported he had been on within the last 24 hours and he hasnt been on msn since.
I have filed a claim through paypal but he has replied saying he has a signed contract which has never happened ( the only thing close is a contract he sent to me to get signed which i never got around to doing )
I havent really been in this situation before and i am needing some legal advice from some people on this forum who have been here before or know what to do.
If so please reply or pm me i also have msn which you can contact me on.

Your best bet would be Paypal, because it could cost you more to fight it through the court.

For the sake of $1000 you should put this down to a very important lesson learned. If a deal sounds too good to be true, then more often than not it is.

I know that this is wrong but I would contact my Credit Card Company and charge back my Credit Card...

Other than that, get a court order and serve paypal to release the guys account details.. then go ask him for your cash back

thanks its pretty hard as im in aus and hes in the usa so it would cost me more in affairs i recently got in contact with him ill see how it plays out.

okay this issue has now been raised again but its worse now as i filed a claim then the guy got into contact with me and said that he had been away for a few weeks but the site will be up tomorrow and when he gets back from work he will send the details if i canceled the claim.
Being new to this i did but i have not heard back from him again i wrote to paypal but no response yet not sure what to do.
If i charge back my credit card what is involved and is there a certain time frame it has to be done by?
if it is needed the date of payments was 21/3/2005 and 22/3/2005 the site was meant to be up and running on the 24/3/05 but still there has been no change in it.

You can do a chargeback and explain the situation to your bank; most likely they will oblige and therefore pass the buck onto Paypal who would then go after his ass and yours combined (be prepared to lose your PP account and/or be banned from using PP).

okay thanks i might have to do this as i would preffer to get my $1,000 and lose my pp account then to lose my $1,000

Chargingback may prove challenging depending on the card issuer - worth trying if nothing else works...

But BEFORE doing a chargeback, be very sure that any any bank account number you provided PayPal is blocked from ACH withdrawals -or- closed (including various associated accounts, such as savings, money market, etc).

AND all associated credit card account numbers provided to PayPal should be closed (PayPal keeps a past record of acct numbers).

AND finally, if you currently have much money in PayPal, request a *paper check* and/or *spend it* - withdrawing with direct depost (ACH) while quicker, can be easily reversed; not final for 60 days - closing bank account doesn't fully protect one from an ACH reversal later.

To be clear, some of my suggestions are extreme and may be overkill for your situation, but do not underestimate PayPal; be sure to read the book length PayPal legal/user agreement you agreed to - it's an eye opener ... and since PayPal is NOT a bank, they're free from most all regulation - they can do pretty much what they please with one's money ... and do :(

Okay this is a long story so ill try and keep it short.
About 1 month ago i sold a name for $3k and i was looking for another business deal to invest in and i had this guy OdditySoftware on my msn who was looking for a 1/3 partner in SigRent.com which i jumped at sent the money right away.
I never heard from him until i filed a claim which then he said he had been away and he will have the site up the next day if i canceled the claim being a trust worthy guy i did.
That was 2 weeks ago and still no contact he comes to the forum every day as he has posts and shows online but he never reply's to my pm's or e-mails this has been going on 1 month and i am quite certain there isnt going to be a site.
I write this as i am looking for different options to get my money back maybe someone can get in contact with him and help me out.
Im only 15 and $1,000 usd around $1,200 Aud is quite alot of money to lose as thats around half a years work for me.
So i am asking for some help in recovering my funds.
Also i am trying to not use a credit card charge back if my parents find out i wont be able to do business online again.
Thanks for your time and hopefully you can help me out i am willing to offer $100 to who ever helps in recovering my money.

Since you sold a name for $3K, the $1K you loss is likely not the end of the world for you; it appears you'll survive without it ... so chalk it up as a lesson learned and move on - blindly trusting people is asking for trouble; written contracts are close to worthless when dealing with a scammer.

With all that said, there may be some hope ...

I did some searching ... but with so limited information of who you were dealing with, I don't know if I'm even close so I'll only post brief information here ...

First I checked Google (click link below) for: OdditySoftware msn

Found some interesting stuff - if the scammer is truly a domain name seller/ webhoster / web designer, there's a good chance someone here can assist you in getting your money back; don't pay anyone to do so - folks who can truly help will do so for free, or at most only for $DNF; point is don't give anyone money to help - otherwise you risk getting scammed twice.

With more information, this person can likely be tracked down and effective action taken, since it appears they're in the United States.

Nope; I don't use IM programs, since chat tend to be a waste of time compared to other contact methods ...
