Some people tell us that our domain name may be breaching copyright. We don't think so. What do you think?

Thank you

With the nice link to eBay right on your site, I think you may have some issues.

But what if the bay-e name is the acronym of a legitimate business name? Would there still be an issue?
Thanks

I dont think you should have any problems as long as your site doesnt seem like its trying to copy them or anything like that.

Would the risk of being sued by ebay deter people from buying this domain name? Or would the benefit of an easy-to-remember name more than compensate the risk?
Thanks

You are right, you are not violating copyright, you are violating trademark law.

You are a cybersquatter, that is quite clear. Not only do you have no interest in th domain, you even make reference why it sounds so good. There is even a link to bay. If I was a lawyer, I would have a screen shot of this and your chances of retaining the domain in a dispute is nil.

Coolalex, do a search on keywords "tm" and then "trademark" and spend about 3 days reading before you post in legals again.

bay-e, if you are contacted, just do as they ask. This is a losing case.

The 1st thing I thought upon seeing the domain name is "TM infringement".

If this layperson thought such, what more ebay itself?

1) Yes, the name does infringe on Ebay's TM.

2) The name is worthless anyways...no point keeping it around and possibly getting sued over it.

Hmmm, legal stuff is always complex ...
Sure is. Much simpler to just ask yourself how you came up with the name. If you intended to profit from the familiarity of someone's TM then that's bad faith.

Of course there are quite a few here that make their living from bad faith regs. (Cyber or TM typo Squatters) I'm not one of them.
