Long Term Parking Company Stole My Car!!!

I have had my car parked with an LAX long term parking company for most of the past four years. I picked it up once after a year and change and drove it for a few months then dropped it off and haven't been back since. It has currently been with them for a little over two years.

I called to check on it and was told by the night watchman that he remembered seeing the 'lien paperwork' on it two months ago and that it has 'most likely' been sold. He told me to call back in four hours to talk with the day manager.

I'm furious! For one it is a small company and each time I have come in they recognize me and they know that I leave it for long periods of time and they joke about it with me. I specifically asked if I could leave it there for years and they pointed to a Dodge Viper that they said had been there for over three years and said no problem.

Now these scum bags have evidently used some clause in the contract I signed to sell my car! Admittedly I was an idiot for not reading the contract, or even keeping a copy of it. But jesus f'n christ.

So my question is what recourse do I have given that they told me I could keep it there an unlimited amount of time? Will I get any of the money from the sale? Any lawyers or anybody with experience or knowledge of this, please chime in.

If they had kept it stored I'd owe them about $6k right now. I just looked up the book value on my car and its worth $20k (private party via kbb.com). So this is something to fight for, even get a lawyer.

I imagine if they sold it they probably auctioned it and got $12k or something and will trump up the charges I owe them to damned near that amount and send me a check for $314.94 or maybe even have the audacity to claim that I owe them money.

Please don't preach about the merits of leaving my car parked for that long at that expense. I didn't plan to be away this long and I may return at anytime - I like having a nice car waiting for me if/when I go back home.

Ouch! Looks like you better dig out that contract & do some reading, or take it to a lawyer. Were they auto billing you? Did your credit card expire?

Contract is lost forever. They weren't auto-billing me. The only payment method they offered was for me to pay when I picked my car up. So I currently owe them $7.95 a day for the last two years. Presumably that is their justification for them selling a $20,000 car....

Will find out in three hours. Unless they have a check for $10k+ with my name on it, I'm probably going to get a lawyer. Might get one on general principle. I loved that car :(

Please any lawyers weight in with your opinion.

At what time they consider it abandoned is not all that relevant now - whatever that time is, it has lapsed.

Logically speaking, that makes sense. Do you have experience with this?

Who knows what BS some shady company might try and stick in their contract. Item 124c: We deduct a 35% service charge for selling the car Item 124d: We apply a 200% penalty on your daily rate if we have to sell your car 124e: You pay our legal expenses in getting the lien etc etc etc. By the time they are done with crap like that I could easily owe them money...

I'll have an update in two hours...

If it turns out you were over 2 years behind and were never charged a dime past any time frame laid out in the contract before they could auction off the car to recoup, your SOL. All you can do now is find out the diference in price, if any.

As I explained to another poster, their only method of payment is for you to pay when you pick your car up. They have your car as collateral so I guess they are ok with that risk. I did not miss any payments - I was to pay them when I picked my car up.

You have misinterpreted the facts. AFAIK I didn't violate anything. I specifically asked them if I could leave the car there 'for years' and pay when I pick it up, they assured me that I could and pointed to another car that they said had been there for over three years.

Curious, what was the car?

2006 Mercedes c230, with something like 10,000 miles on it.

I would be looking into getting a contract and reading it before leaving my car there...forget about counting on them to call you in future.

glad to hear to didnt loose your car, and two years sitting you are going to need to take that car in for a servicing/tune up....LOL
