Name Issue, For ex: I own EXTV.COM and Complainant is XETV

I have a domain similar to EXTV.COM and the company XETV sends us a cease desist letter asking us to give up EXTV.COM as they have trademark on XE and XETV.

Do they really have a case here? I'm new to this legal issue. Please advise what to do.

More explaination...

for ex: A company called WFBank which stands for wellsfargo bank owns wfbank.com (that has trademarks wf and wellsfargo). Let us say I have a domain name fwbank.com over the last 10 years.

WFbank.com now claims that it want FWbank.com as it has trademark letters in reverse order.

Please let us know your thoughts.

Depends on if you are gaining traffic that was intended for them and what you are showing when they get there. Ask yourself honestly if you are profiting off their TM (traffic or cash).

They do not have a trademark for XETV, no one does.

On top of that xetv.com redirects to a pay per click chowchow.com,
so there claim amounts to a total nothing.

Your domain extv.com is a real web site, a nice one at that.

There are a few different trademarks for - xe -, but I can't see that having
any effect on you.

Okay, so I see you have a domain similar to XETV, not actually EXTV

Still, there is no trademark for XETV.

which is also why any opinions on this case are little more than mental masturbation, there is no way to accurately gauge the situation.

Maybe it's MM for you, but the fact that xetv lied to mraavis stating they had a trademark for xetv is relevant no matter what his domain name is.
