Nice article. I think the bigger problem is those on the ICANN board. Need to clean that up IMHO.

Most likely the genesis for this bill is to be found in the beginning of the article: (emphasis is mine)
1. The law can be twisted to violate free speech. I suspect this is the reason the law was written in the first place. A politician was probably mad that someone else owned her domain name...
It looks like another case of politicians making the laws to promote some agenda of their own.
I actually believe the biggest threat to the Internet as we know it is government interference of all kinds, at all levels (state-level is already bad enough)

Coupled that with many people complaining of their domain-personal namesake
being taken by the likes of kenyatech and/or unasi, it's a volatile mix.

These guys just don't think things through. How many people actually have a name that is unique to them? What are you going to do about the John Smiths of this World.

Unfortunately, today, most legislation is drafted in response to critisism from the Tabloid press, which only get half a story in the first place. Democratic government may have it benefits, but the checks and balances are often to be found in the irrationality of the system. One of the reasons that China is moving forward is that they are actually able to formulate and implement coherent policies, of which many Western Governments seem incapable.

I found the quote below on romantic-idea.net:

“Buy the domain name of your partner's name if it is available for example www.TanyaJohnston.com. Create a web page containing a romantic poem and a picture of a rose. When your partner is surfing the web, casually ask whether she has ever checked to see whether her domain name is taken. Let her type it in to discover her page.”

If passed, the law could affect divorce proceedings maybe.

Agreed, that is just stupid, how do you prove who would be allowed to register their name??? If my name was actuallty Brad Pitt then I should have every right to own BradPitt.com as far as I am concerned...

Maybe this law should apply to the .name ext only.

Perhaps Betty should register BetLittle.com if she is champion of this act.

Creature.
