out of court settlement = bad faith ?

i am involved in a complex case, and don't want to be accused of bad faith by trying to sell the domain to the plaintiff.

However, i would be interested in settling this matter out of court. does showing my inclination to an out of court settlement constitute bad faith? what if i mention a figure for the settlement?

I was involved in a civil case and our lawyer told us that attempted settlement negotiations could not be used by either party as evidence in the court case. There are probably some qualifications to this and it may depend on where you are in the process.

Attempting to mitigate any dispute by way of a financial settlement is not bad faith. It's that simple. Let them know that you believe that you have rights to the name and the settlement talks are in that context......then get the maximum cash.
