i have this name in french and am being attacked by a company called 'property loan'. i have been told by a lawyer here in france that in europe, a company can acquire a defacto trademark on a generic term if they have become big and famous enough to be instantly recognised. she says i will lose the case as they will do surveys in the street asking people what they think of when they here these terms and most will mention the company. is this true? have i no recourse?
when i mentioned they could not trademark this term in the beginning because it is generic, she agreed but said with time and advertising etc, it has acquired the notion in jurisprudence as being effectively trademarked. any comments?
i don't know if it has any implications but i am a foreigner living in france and didn't know of the company when registering the domain
