say i brought a script
and was one of the first to get the script before it was for sale
and offered it to the public to use on occasions
I was never told that i couldnt offer it for public use from the creator when i got the script, in fact i told him/her that i was going to offer it in a tools section on an upcomming site and asked if he wanted a created by <site link here> or <email/name here> link but he/she said they can do without and gave a headsup saying to watch for people using external tools trying to access the script if its publicly available

so he/she knew i was going to use it publicly
i then today about 2 weeks after i got the script get a message from someone who bought exclusive rights to the script saying that i am not allowed to offer it to the public as its hurting his sales and to send $500 to them so i can offer to public or send $1000 for exlusive rights to the script or stop using it publicly or they will be forced to deal with it there way (dunno what that means), i then explain and they say that the creator denies letting me use it publicly

just want to know your thoughts :huh:

yes,

agreement was that i was not allowed to redistribute the script
eg: sell it to people

a quote from the top of the script "configeration"

Don't take someone else's word for what the creator said. In fact, it sounds like they shouldn't even be talking to you at all, they should take it up with the creator. If they think they got exclusive rights and the creator had already sold it to you, they need to contact the creator to be refunded for these supposed "exclusive rights" that he had no right to sell in the first place. They sure as hell can't ask you to pay more money, because they have no right to ask for money as you never bought anything from them and they hold no power to try to tell you what you can and can't do at all.

This assumes that all the facts are presented as you explained.

I guess it may all boil down to what form of ownership you originally purchased.

Did you pay money or were you a free beta user?

Is there anything in writing?

Did you get an assignment (fee simple ownership) of the technology?

Did you get a license? If so, did you get an exclusive license or a non-exclusive license?

What were the terms of the license? Did they include the rights to re-sell or sub-license?

I am not an attorney and this is not legal advice.

Sounds about right to me.

i didnt pay money so to speak
but it was part of a domain deal
creator paid some of what i was offering a domain for sale at and sent me the script

didnt get a license eg: a license number as the creator didnt offer that i dont even think the new "owner" gives license numbers as its only a one page php file

didnt get an exclusive license or resell rights
but what i meant by offering it to the public was that i have the script on my server for anyone that visits it to use but i dont resell it as i dont have the rights for that

terms of the license were not to resell or give away the script(php file) but was allowed to offer it for public use


it seems now the "guy" that bought exclusive rights is now selling the exclusive rights to someone else and this will most likely happen all over again if the seller doesnt tell the truth or tell everything


havnt had anything more from the exclusive guy ...
