Hi, there is a .net domain about to drop that is a clear TM infringment. The TM holder has the .com. The company manufactures many different sporting good products. The domain in question is the exact name of one of their products.

The .org is owned by others and redirects to a site that sells this company's equipment as well as all of its competitors' equipment. The .org would seem to be a serious infringment as well.

My questions are:

Why does the TM/.com owner allow the .org to operate and not C&D them?

Why has the .net been allowed to exist and not been C&D'ed by the TM/.com owner?

Do they not Care? Realize?

Just trying to understand, thanks for your time.

Enlightened TM owners have taken the position that if someone is going to pay the registration fee for a do-nothing domain that is a variation of the trademark, then that registrant is simply doing them the favor of paying the registration fee for a do-nothing domain.
