Hot property is definitely the right term for these - TOO hot in fact. Heisman and Heisman Trophy are both strong live trademarks. Odds are you'll be donating these two to the New York Athletic Club.

I should have checked the TM status before registering the names. But I am not going to be selling any products or services.
I bought the name's because they have the .us Tld; I paid in u.s. currency for a .us Tld. If I don't put up a website using these names, I think I should be able to keep them in my name. There is only one .us Tld; and if they want it, they'll have to buy it from me TM or no TM I am not just turning them over to them. If I have to, I will find a lawyer out of shear principle of the matter. If I lose I lose! But if I win! the lawyer and I will make them pay our asking price. So are there any lawyers in here that will work contingent? If not, I will find one if necessary.

Gary,

Principle? If they want it, I bet the ranch and farm they will not pay you for it...it will be taken from you. Why would a lawyer work "contigent'? What would he (or she) gain by handeling your case? If you did fight to keep the name, you would incur thousands in legal costs and for what? How can you possible profit even if you did win? Pick and choose your fights wisely...this one is not a wise fight.

Anyway. good luck to you.

Shoot! Did Austrailia take the Heisman from us again? Maybe you were thinking more along the lines of the Americas Cup?

You may not want to go downthis path until you get a C&D letter.

They might come after you, they may not. I think a lot of it depends on how you use the site. If you defame their TM, you can bet they will come after you.

If you do nothing, then they might just sit there.

I have been on both ends.

I had a SE page on a name for 1 year. Then I put adult stuff on it. WHAM! They bypassed the WIPO and went right to a summons.

I have also have flagrant TM violations that all I did was have a SE page and nothing ever happened. I sold it to a legitimate third party who could show legitimate interest (his last name was the same as the company's trademark).

Good luck!

Thanks Everybody for the time to give me some good advice. I will just do nothing and see where it go's from there. I'm sure they will find out sooner than later, that the .us's I have are gone.
After all, The Heisman Trophy with a .us is a proper fit! Do you agree?
