Sedo and Drogas.com breach of contract

Hello guys,
Need advice concerning my purchase of Drogas.com from user candycandy via Sedo auction.


7 weeks ago I purchase the domain name drogas.com via Sedo auction. Upon winning the bid I immediately sent payment via wire transfer to Sedo. To make a long story short… the seller refuses to push the domain to my account and Sedo has not returned my 10K. Sedo claims that they have been trying to contact the seller for the last 7 weeks but have been unable to contact him. Sedo currently has the name still listed for sale at http://sedo.com/search/searchresult...erid=&search_type=advanced&keyword=drogas.com Sedo’s policy states that all domain names for sale must not be “ encumbered by the rights of any third parties”. I don’t understand why Sedo would still have this domain name listed when they are clearly aware of the violation of my contract. In fact, this Sedo user still has over 1000 domain names for sale at sedo and had a few listing here on the forums at http://www.dnforum.com/f393/drogas-com-thread-294996.html

I will be seeking legal relief for my financial damages plus legal cost. I also will be asking for “specific performance” of the sales agreement. http://mediadrip.com/contract.jpg

I would love the here from my fellow Domainers that have been down this road before for any tips and suggestions.

Did you contact Sedo e.g. by phone to close this transaction complete due to lack of payment? The max Sedo waits on its own is 5 business days, so it appears that you agreed to extend the waiting period while they are trying to contact the seller. Therefore, call Sedo, have the auction closed as incomplete and then use the seller's contact info to pursue legal remedy.

Also you can definitely request to have the seller banned from Sedo and have his domains removed.

Its a hell of a name. Multi-language meanings, including Spanish, Portuguese, and Italian...I am sure more.

But, how Sedo can justify holding the money is beyond me.

They are not going to due a damn thing to the seller. They are not going to ban the seller, they are not going to sue the seller for breach. They are not going to do a thing therefore it makes no sense to hold the money.

That is why when the transaction does not go through, they release the seller/buyer information to you in case you want to do something.


Also, a word of caution...
