There is already a "dropcatcher", and it would be in quite bad taste to use the plural for a similar service.

Correction Cowboy: You can file for a Federal registration in anticipation of using a mark in commerce (6 months, I believe). A small extra fee and some "paperwork" (it's probably online by now) is involved. I know, because I have done it: hiOsilver(R)

The smart order of doing things:
1. Get your domain name
2. Research ability to get TM (or SM) on name
3. File for your Fed TM (or SM) registration
4. Start business

Step 2 is important.

Anyone wanting to know more should buy the book on doing your own TM by Nolo Press. For most people, this is best first step even if you plan to hire a TM attorney. In fact, anyone serious about domain names should buy and read the book.

For registered trademark rights, you can file an application on what is known as an Intent To Use (ITU), but rights do not actually adhere until after you use the mark in interstate commerce. If you do not use the mark in commerce within 6 months, the ITU application is abandoned.

For common law trademark rights, use in commerce is also required.

So to repeat myself: TO GET TRADEMARK RIGHTS THE MARK MUST BE USED IN COMMERCE.

If you owned houseware.com, and there was a site called housewares.com, you mean you shouldn't develop?

Actually I disagree with you both.

1. There is no service that I can see operating at DropCatcher.com, and the owner of the plural would be wise to document that fact.

2. "DropCatcher" is not a generic phrase. A slang phrase in a niche industry.. maybe. Generic phrases appear in the dictionary for their meaning. The fact that the two component words are dictionary words is irrelevant, because the completed combination is the subject.
