Sueing a China-based spammer?

Does anyone know of an effective and cost-effective way of sueing a spammer that seems to be based in China, or would I just be wasting my time?

I'm asking because they've been forging return addresses at the domain of one of my live sites, which is causing me no end of hassle with my hosting service, not to mention abusive mails from people who think I'm the one spamming!

"cost-effective" is a very relative term. But if you send your private jet to pick me up in Philly and fly me to your office, I'll be glad to provide a free estimate.

Before paying for any private jets to fly lawyers around I would find out where the spammer actually is. The simplest way is to follow the $$ namely how are the recepients of the spam supposed to pay for whatever is advertised in the spam. You may find out the spammer is a lot closer than you think, or you can find a "nexus" (bank accounts, payment processing, affiliate company etc you can go after nearby).
