I have a domain called 4ha.us
Its called a hack domain as word is created using the dot in the middle.
I just checked and haus is a TM
Now does my domain qualify as the TM name (the TM is for "haus")
Or does the dot in the middle make it safe to use???
Thanks!

Well 4ha.us is one of the domains. Issue is that if i register any name (word with . in the middle), which is also a TM of a company (without the .), would it be safe from TM issues???

like in the instance of ha.us

Is there any article with references to something like this??

Thanks!

People tend to want to reduce trademark law to a set of mechanical rules. It is not a set of mechanical rules.

Let's say there is a top-level domain ".le", and I register app.le

Let's then say that I start selling off-brand computers and I have a webpage there which says, "Buy Your APP.LE Computers Here"

Is that going to be a problem. Sure it is. I am intentionally trading on the "APPLE" mark for computers.

So, let's say I register the same domain name and sell apples.

Is that a problem? Of course not.

"Haus" is the German word for "house". It might be a trademark for all sorts of other things, just as the word "apple" can be a trademark for a computer company, "shell" can be a trademark for an oil company, and so on. Any word, arbitrarily applied to goods or services, can be a trademark.

The issue is not "what is the trademark and what is the domain name?" The issue is "what is your intent, and how are YOU using the domain name?"

Thanks for the info jberryhill.
As the name suggests haus is an alternate word for house.
The obvious optimum usage for it would definately be in real estate.
Now the TM is related to pre-screening for mortgage / loans. These loans i reckon are for homes too but not just for homes.

haus is a very very popular replacement for the dictionary word house. Can it still be used in the real estate business or does it infringe in any way???

Thanks for your suggestions!!
Rohan.
