Let's say you're thinking about registering a two word .com name. There will be a hyphen between the words. The non-hyphenated name is trademarked by a company but the trademark is not related to what you'd use it for; the trademark is for an unrelated product in another industry.

With this said, would you still be walking into dangerous territory by registering the domain?

Not necessarily. There are many marks that co-exist, despite being identical. For example: Delta Airlines and Delta Faucets.

However, be careful. There are some marks that are so strong that it won't matter if it is in an unrelated field. Furthermore, watch out for what you consider to be "unrelated." There is a concept known as the "natural zone of expansion," which gives existing marks room to grow.

PLus you could have a non-infringing site on delta.com if you had an informational site about the dictionary term delta:

a nearly flat plain of alluvial deposit between diverging branches of the mouth of a river, often, though not necessarily, triangular: the Nile delta.

Just make sure no ads that pop up are related to fauscets or airlines.

Hi thanks for the responses.

The term is a trademark, not a tradename.

I forgot to mention that there are numerous companies that have trademarked this term. Non of them related to each other.

When I type the "term" into Google.com their web sites don't even pop up.

None of them own the non-hyphenated name in .com, .net, .org, etc.
