closed TwoWayTV please help

Yesterday I heard some people talking about a new technology coming to America that has been in England for a short amount of time called Two Way TV. Where you can interact with others and play games via the TV concerning Sports shows or whatever that are currently on. That's the gist I got. I thought it was a general type of service so I looked up the name and got:

TwoWayTV.net

I checked into it more and that is the name of a company that does the service. TwoWayTV.com does this and has a nice site. I checked an online trademark site and didn't find any trademarks for the name. I went ahead and contacted TwoWayTV.com asking if they were interested in acquiring the name. I quickly got this reply,

"sounds interesting - how much were you thinking?"

I haven't responded yet. How should I respond?

yeah this is becoming a big thing over here in the u.k. except its called 'insert broadcaster name here interactive' i.e. SkyInteractive

and amounts basically to a normal modem built into the satellite decoder box that can dial up to the tv provider and send them info that allows you to interact with the tv. and this is for things like a movie channel where you can watch 8 different trailers of current films and read the latest box office reviews etc. or with the news and weather you have various feeds that show you different information all on the same screen and you can switch between them to hear the sound for a particular feed...

the biggest uptake though is on the 'reality tv shows' like big brother... they have 4 continuous feeds from the house through out the day and night and you can vote for the evictions etc from your remote...

its a big technology but is still in its fledgling stages so i would take that into account when dealing with these people also you are offering what is viewed as a lesser tld than their current .com so that may affect the price...

"$100 - is that the going rate for this kind of thing? Not really interested if the cost would be more as we have survived this long w/out the .net. "

if you could do with the money then a profit's a profit.

really its down to how comfortable you would feel making a $75 or so profit on a name.

if you think you can get more if you hold onto it and you can afford to do so then do that instead. but a lot of people here have said recently it is harder to sell a .net, .org, .info if there is a developed site on the .com

This was thier reply,

Well,

Once again I am an idiot!

When checking for a trade mark I went ahead and typed
twowaytv (which brought nothing up) but guess what?

Two Way TV sure as hell is trademarked and I got a legal email.
Damn!

Anyone who has gotten one of these in the past:
Do you still try to sell them the name to aviod any leal costs. What do you do?

I believe you are ok to ask for your expenses from this domain... which amounts to reg-fee

but i think you may have ruined your chances approaching them with the name as that could be viewed as registering the name with bad faith...

post this in the legal section for a better answer. our resident legal eagles only check that section i believe.

Remember,anything over regg fee is a profit. Sometimes we get
caught-up in the energy generated by a potiential sale.Thinking
too much, am I selling too low.
Sell and move on the next one!
