"Thank you for your email to the Advertising Standards Authority.
There are new 'soft opt-in' rules in the 11th edition of the British Code of
Advertising, Sales Promotion and Direct Marketing (the CAP Code) which will
come into force on 4 June 2003. From this time marketers will have to
obtain the explicit consent of consumers before marketing by e-mail or SMS
text transmission, save that marketers may market their similar products to
their existing customers without explicit consent so long as an opportunity
to object to further such marketing is given on each occasion.
Unfortunately until these new rules come in to play we cannot take up
complaints about the receipt of unsolicited email. We can however look into
complaints about the content of emails should they be misleading etc.
A full copy of the CAP Code can be found on our website - www.asa.org.uk."
