Excellent test case Nic that will send a warning shot over the bows of any registrar which doesn't try to prevent domain theft taking place.

A good quote from the article:
"For over two hundred years, courts have consistently said that when a thief presents a forgery, the responsibility for the loss lies with the business in a position to detect and prevent the forgery, not with the innocent customer. Here, Network Solutions actively deprived Mr. Kremen of the opportunity to assist in thwarting the forgery before it was permitted to occur."

And another:
"There can be little question that a domain name is inherently a lucrative piece of cyber real estate, generating substantial revenue from its web surfers," says Pamela Urueta, an attorney representing Kremen. "As anyone who owns a domain name knows, they are valuable property. Even domain name thieves such as Mr. Cohen appreciate that reality."

Let's get ready to rumble. I hope Verisign will get hammered. The owner of sex.com is good for at least a billion dollars. So he will have the ammo to fight them.

Yes, at least a billion. That's a figure I read they had generated since the owner bought the domain (read it last year). Make sense in my opinion. SEX.COM is the BEST domain in the WORLD. And it is one of the most visited sites in the world as well.

Verisign got away with murder, and will continue to do so. No amount of fines will hurt them. The time to nail them was back when domain owners were being stripped of their names every day of the week and the only response was the ubiquitous NSI mouthpiece Cheryl Regan blah blah blah disclaimer (ie weasel move).

Sex.com has the benefit of the media spotlight. Not so for all the people that Verislime managed to screw by not taking any responsibility for domain thefts.

be fair, they did routinely offer a free consolation registration of the available domain of the losing parties choice.
