what happens if you sell the domain after you got the C&D letter? Would you be able to tell the company you no longer own the name? Just curious...

That would be bad practice on your part. And of course your name would go in the people to avoid dealings with forum :) Just don't do it.

And if you received a C&D letter, sold or even deleted the domain, they could still come after you.

Care to elaborate? I've never heard this happening, receiving C&D is like a warning if the domain was indeed used in bad faith and yet you delete or agree to transfer back how will they substantiate further loss based on misuse/act of bad faith?

That would be bad faith to sell a name when you received a c&d. However, unless you are asking this question as a by the way, additional info wouldn't do any harm for the benefit of all members of this forum. thanks

I understand you're curious.. but just note, you will be under the radar from alot of buyers here when/if they see this.

To be clear, selling a domain that has issues (IE- receiving a C+D) and not telling the buyer leaves a nasty door open.

1- You are still liable to the TM holder, even though you no longer own the domain. You are also subject to any and all actions as if you still owned teh domain (monetary damages, fines, legal fees)

2- You did not have the rights to sell the domain, thus, you fraudulently sold the domain to an unsuspecting buyer. This means the buyer can come after you for for monetary damages, legal fees (both against you and possibly against the TM holder if they come after him).

So it is not a good practice to do so. You violated TM law and are still liable for all damages and penalties. You are not absolved from your actions.

Here is an analogy from my own 'hard lessons learned'
Like dumping your girlfriend once you saw the new positive results of the pregnancy test - although it may be a quick and not uncommon knee jerk option - some decisions are better made before you jump into the back seat
With the big dogs the old boring question of 'who knew what and when?' has a way of coming up eventually - then what you did once you knew may have greater consequence than the first question.

Time to fish or cut bait - but make a decision, roll the dice, take the chance, or the lumps , and move on to the fish
