Who gets to keep the domain?

If a web designer comes up with an idea for website, domain name and establishes a profitable site for a client, can he/sh claim the domain name as theirs if it is sold.

The company is selling the biz, website, shopping cart, products etc. to new owner. Can the webmaster keep the domain name since it is high pagerank and can be profitable?

If the webdesigner was a paid employee at the time and came up with this while he /she was being paid the site belongs to the employer.
There should have been a non-comptete in place as well to protect the employer.

Client pays for site and services, client owns site and services. Simple.
