As a member of Yahoo! Search Marketing, I was shocked and surprised to receive a Class Action Suit Settlement notification today penned buy the Attorneys of CheckMate Strategic Group of Florida.

Looks like CheckMate is trying to put the BlitzGrieg on Yahoo! and get in on the Big Money game of suing for a living.

This will contine to undermine the Pay Per Click Industry, eventually killing it. It's like trying to hurd Cats.... more

The WORST part is that "Although Yahoo! does not believe it has done anything wrong and continues to deny all claims and allegations of wrongdoing asserted in the Action, Plaintiff and Yahoo! agreed to enter into a settlement agreement..." the coucil for the plaintif "intend to request $4,950,000 in attorneys' fees plus costs in an amount not to exceed $25,000."

5 Million to say NOBODY DID ANYTHING WRONG but WE NEED TO FIND WAYS TO MAKE SURE IT DOESN'T HAPPEN.

How long, at .05 cents a click, will it take for Yahoo to make that up? I guess WE take it in the shorts, so what's it to Yahoo?

Just another way for the 'sharks to try and squeeze money out of an industry they know nothing about.. "But hey, Google settled for 90M, so let's try and get some out of it."

They can't break the PPC industry. It is already far too established.

This will blow over quickly.

This hurts us as webmasters more than anything. The more lawsuits like this are brought on and paid on the the more the PPC providers will shave to compensate. You as a webmaster are already giving up 50% of your clicks/traffic on adsense even if you are an honest webmaster to compensate for those who aren't and to satisfy these companies who don't know how to manage their advertising budgets.

I think that a class action is necessary in order for fraudulants to stop deceiving people. I guess for a few months we will all be in some sort of hardship but if Yahoo tries to get that class action fees back from us, they will be begining another type of class action (who will be happy? Only Attorneys) I hope this will be a lesson for them and will stop any activities that were deceiving. Think about it, why would WalMart spend a lot of money to stop class action? Also, I was wondering, why Yahoo... there are worse companies out there..... maybe in the process right now!!!

It means that there is going to be a $4,975,000 Bill JUST for attorney services that Yahoo will have to cover IN ADDITION to whatever the actual financial settlement for the suit turns out to be.

In other words, the COST to Yahoo (and the rest of us) will be:

Settlement Amount: $X,XXX,XXX Million dollars
Attorney's Fees: $4,950,000 Million Dollars
Costs: $25,000 Thousand Dollars

The short version... a few people just scrapped $5 Million Bucks off the tops of our PPC Rev for pretty much nothing.
