Well, let's run through some scenarios... You tell me what result:

1. The TM claimant pre-dated the domain name, and had an agreement with the prior domain owner that was non-transferable.

2. The TM claimant did not pre-date the original owner of the domain name, and the domain transfer did not include any goodwill or ongoing business. It looks like the OP picked it up after expiration, and received nothing from the original owner.

3. The poster is actually confused about either the status of the TM or the validity of the claim.

Snot enough info.

I ended up selling the domain for $2,500.

I was able to make a few bucks, and the new owner was able to save the WIPO and attorney fees.

Win/Win
