Anyone with an iota of common sense & Internet knowledge can conduct their own search - to even suggest or hint that there might be issues, especially when there are none, is a guaranteed sale destruction.
A few days ago a 3-letter .com domain was posted for sale; there was a UDRP decision and lawsuit against the former owners. I found that out and my message was relayed to the seller - not on the thread but via PM. The way I am sensitive about such things, I expect others to be; courtesy is something that one can - and in domain forums pertaining to sales should - be trained for.

It isn't always easy to research a particular name, although buyers should exercise good judgment, CAVEAT EMPTOR.
However, in my opinion, sellers shouldn't hide pertinent adverse facts: UDRPs, trademarks, lawsuits, threats of legal action, etc..
OK, let's talk about destruction. Allowing sellers to hide such adverse material facts... does that totally destroy community trust? I think it does.
If it is OK to hide material adverse facts that are known to the seller, basically, you can't trust any seller on the board. Obfuscation is OK.
Is that really what we want?
