John - didn't the complainant in peaches.com argue the same thing, that it didn't matter if it was bad faith when the domain was registered, just that it was bad faith use later on?
Yup. The peaches.com decision came in the morning after the response was due and submitted in this case.
So, I'm really hoping these yo-yo's file a supplement, so I can throw peaches at them.
Then again, we know they are aware of DNForum, so they can consider this a call-out.
