If the email is real, sedo will just hand over the domain to the legal owner.
They probably waited for the domain to sell before striking, as now it makes the seller look like he was just in it to make a quick buck.
I've recently started checking ALL trademarks for .mobi domains i may purchase, just incase, its just not worth the hassle.
I hope this seller manages to sort something out.If the domain does indeed belong to the .com, then i don't think they'll persue it as long as they get their domain, it wouldnt be worth them damaging their image for what they could possibly squeeze out of you in damages.
The email looks fishy to me. Especially with this statement "Any comments or statements made herein do not necessarily reflect those of Marketiva Corporation, its subsidiaries and affiliates. For more information please visit our corporate web site at http://www.marketiva.com/" I can't believe a company as big as MarketIVA.com would not have one of their attorneys handle such issues and I don't believe they would include such a statement in their letter. I suspect MarketIVA.com was one of the losing bidders.
IVA shows 113,000,000 results on google and thats what makes the name so valuable IMHO. Surely somebody checked out the TM issue before they started bidding tens of thousands of $$ for the name.
