3: provide us with an indication of the extent of your use, so that our clients can access their damages; and

How about ASSESS their damages?

Tell them that you considered turning the name over to them, but if you do that they are acting like a business, especially with the trademarks, lawyers and such. That means they'll lose their tax-exempt status with the IRS, and you're required to report that. You'd feel real bad if the IRS made them pay taxes, and of course they could spent a few hundred thousand to fight it. So tell them to got ahead and tell you how much damage was done to their BUSINESS, so you can forward that on over to the IRS and get the ball rolling.

Or, if they're really jerks, they're obviously not following their "bible", so go ahead and redirect the traffic to a hardcore porn site.

I think when you trespass on someones property, and you get caught, and they're nice enough to not load your butt with buckshot, you should apologize and leave their property. If you don't, you deserve to get your butt loaded with buckshot.

So you've got nothing to lose? Well quit fighting with the local baptists and spend your time building personal assets.

Your metaphor is misleading. It's his property for now, de facto and de jure.

If you buy a title deed to e.g. a tax-foreclosed property, and the former owner "gets your butt loaded with buckshot", he's a wacko.

I think there's some truth to your post and the shoplifting analogy :-D

Then again, maybe black and white isn't accurate, and there are shades of gray here...

Let's say I register scientologychurch.org (fictional example, already parked), and use it to display the controversy and criticism around this "church".

To contribute towards my bandwidth bill, I could even include some google ads.

You could claim that's trespassing - but there could also be conflicting legitimate interests at stake here (fifth amendment etc...).

I think sometimes it is best not to give the poster hope or " bad advice " when you do not know what organization it is ( as I do ). As long as he covers his bases in regards to future ramifications he should hand it over. It IS a fairly clear cut " TM " case and he has parked it.

...According to the Qur'an, theft may be punished by amputation of hands...

Just came to my mind, since Islam and shoplifting have been mentioned in this thread. Fitting punishment for those domain criminals...
