I was interested in the domain Casinon.com

I sent PM to the owner of the domain and he said there were a few offers.

I asked the seller his lowest price for the domain.

He said it would be $400 because he had 2 offers for $350.

I accepted to buy it at that price. Now he sent me a PM saying he would sell the domain Casinon.com to the other domainer for $450 because it was higher.

How do I proceed?

It all depends on how the seller phrased his responses to you, and what level of English you both speak. If he said someting along the lines of "I have 2 offers at $350, I am accepting offers from $400", then you should realize that you are still in a situation with multiple offering parties. If he said "first $400 offer takes it", then that is a firm offer. It was probably somewhere in the middle "I'm looking for at least $400", etc. Asking "your lowest price for the domain" is vague too.

Since you knew he had other offers close to yours, I think you are naive if you think you had a solid deal at $400 - of course he is going to let the other interested parties know the current offer is $400 and see if they move higher. You should counter-offer, or move on.

Unless his words were $400 and you got yourself a domain there is no wrong doing. To me it looks like he said that would be the minimum but not that he wouldn't sell to a better offer.

You'd still be wrong.

If you are the only interested party, then yes it is a deal. Since you knew he had others interested, you can't assume that $400 was meant as anything other than the next offer amount.
Lowest != Only/Last/Final

You have enough experience to know better. If you have three interested parties, you are not putting a firm price on anything (especially one marginally more than the other offers).

You are playing woird games here to tarnish someone's reputation over something you had no reason to expect. Really, this is hurting your reputation worse than his. ANyone reading this better make sure to get out a dictionary and define every single term used and place disclaimers on any correspondence with you, lest you try to interpret it the way you want and try to extort them or defame them publicly.

right not to sell if they get a higher offer unless and until they have confirmed and accepted a firm offer from you and agreed to sell you the domain
for that offer. I think you have been here long enough and in this business long enough to make these claims and defame anyone. If you want the
domain then make a higher offer rather than posting in public forum and trying to defame some one for wanting more money for their domain.

"No meeting of the minds" and no consideration paid ... hence, imho, don't even waste your time. Move on.

Typically, an enforceable sales agreement requires the buyer and seller to have mutually agreed on a price and money (even if only a small deposit / or something else of value) to have been paid and accepted by the seller.

Post the exchange, also before you replied sold at $400 did the other party offer $450?

Deja vous. Didn't we just have a similar thread but with the seller? :)

I think it was ruled that even though it is a bit greedy for the seller to back out of a deal because of a higher offer, nothing "illegal" was done especially since no money was changed hands (even though in the other thread the first buyer did pay but was refunded).

Well he said he said the BIN would be $400 but no where did he agree to sell it to you for $400.

Also... I hate when domainers try to play that whole what is your lowest price game. I've had buyers missed out telling me they would have paid more because they wanted to nickle and dime. If you wanted the name you should have just made a decent offer from the get go. It's your loss. Stop being cheap if you want it. Just my 2 cents.

You proceed by letting this be a lesson learned and not posting stuff like this in public.... 'domain in bold' and 'username' because you failed in a deal.
