Maybe you've not read the C&D you had sent out. Go back and read:

http://www.chillingeffects.org/acpa/notice.cgi?NoticeID=526

You were after the domain name -- you didn't mention content whatsoever. "Our client has recently discovered that you have registered the domain BLAIRBITCH.COM which infringes on our client's trademark."

Go back and read your own C&D, and show me where you talk about the content of their site, and offer them the ability to remove the content, instead of just paying you the $60,000? The only remedies that *I* can see are 1) stop using the domain name and give it to you, or 2) pay the $60,000.

If you can find a different remedy in you C&D, I will be amazed.

Actually that is true. Until you posted it I never even remember seeing that letter. I think Howard wrote several and when he got no response he followed it with something stronger.

Rick, as George pointed out, you yourself own [2 word] domains which contain the [1 word] trademarks of others inside your domains.

Yet, you send out C&Ds to others who do the same.

Could you please help us reconcile that apparent contradiction?

that Gary Kremen has a registered trademark on the PRINCIPAL register:

No, he does not.

Please, folks, read those USPTO database records carefully.

Rick, are you proposing that your foot --or your personal sense of entitlement --be made the standard of the internet?

No, he is posting a rationale for what happened. He is not obligated to do so, and nobody else is obligated to agree. I don't think your threat to sue me over posting a linkto a WIPO decision should be the "standard of the internet" either, but we are all entitled to our perceptions.

Now, about that pure grape extract at pge.org... I can't seem to find any again.

Oops, thanks for catching that. The hotels.com and bet.com ones are fully registered, though (just checked them again more carefully).

This is so non-sense and I don't undrestand what these guys are trying to do with their idiotism ideas.I gurantee they have no right for this and UDPR will refuse their request ~ Bitch
in my opinion when u search for bitch.com it should give similar site to bitch.com like ALEXA does ;who cares you have bitch.com people need site content not PPC that only profits these people . and I also recommend no one call BITCH anymore because it goes to BITCH.COM and they profit ~
Listen to the song "You are my bitch" instead so similar songs ~ i wish there was an ltd called CUM so i could get Bitch.CUM

Sooo, The sites who received the letters.. Were they using "bitch.com" to get better placement to steal your traffic? Or, did you just assume they were doing this and went after alot of the good NAMEbitch.coms?

I mean, I see where you are coming from, but did you go after the ones that were doing this or after all of them..

All I want to know.

Oh my gosh, someone just regged RickIsMyBitch.com.......

Nah, I like George and Rick both. Good to see an exchange of ideas here. I'm not a big fan of C&Ds sent by anyone, as most are pure crap.

I think it just goes to show that all of us make mistakes. However, not all of us admit that we make mistakes.

No witch hunt --- maybe it's better termed a "bitch hunt"?

who made a mistake and where???
is all a matter of perception, which is a very subjective thing.
I see points of view being different, which is a good thing,
BUT, I also see vendeta type of reactions here, which is unfortunate...

If you put yourself out there for a certain cause and then something surfaces that appears to depict you doing the very thing you're against, well yes -- that's a mistake.

Any which way you look at it.

I could really care less who is involved here, but it certainly appears to be a mistake if you somehow weren't clued in to the content of a C&D letter sent on your behalf.

why should anyone clue anyone about their private matters and strategy?
You are asking for pandoras box to open....
If you research enough, with an OPEN mind, things take a different twist.
If not, as we say, kali nixta....

Are you serious? Whenever you spearhead or take on an initiative you are opening pandora's box yourself. I'm afraid you're not really understanding the full issue. Any average domainer would certainly need not explain these type of matters, nor should they become public. But one could easily argue that this domainer has put himself out there for a cause, therefore making this more of a public matter.
