In a pickle.

The first to post was Acroplex... but i got a PM from Chord... stating that he was the first to respond. Who do I give the domain to?

"Post SOLD to claim" is not a pre-requisite for this sale. I PM "SOLD" to the seller on 01-18-2006, 02:40 PM EST. AFAIK, I am the first to claim the domain. Thanks.

Since you didn't specify for PM's only in this thread, it's pretty obvious that it's a public, open sale.
My post is the only one posting sold for that domain.

The thing is i had no preference and the first thing I went to was my PM box, I responded to Chord and then i saw my thread stating that acro bought it, so confused with the names I thought Chord posted for good measure, but it really wasn't him.

Do I give it to Chord? Do I give it to Acro? Do I have a draw, winner is closest to my number? Do I Ask for the best price?

Yeah I was thinking i'd get neg feedback, and plus I don't think it would be fair, just wondering what I should do.

The way I bought domains was, one post on the thread, then do a followup PM. But I got one and not the other from both of you, which is why I was confused. If a mod / admin could clarify this, I'd appreciate it.

The purpose of a thread is to publicize the availability of a domain for sale.

If I follow your logic, then if you received a private offer via email from - say - Yahoo.com to buy the domain from you in the same timeframe, then Yahoo should be given the domain, despite not posting sold here or via PM.

Then what's the point of making a sale thread?

Thats right. Although I got the PM from chord about 2 give or take hours before yours, thus, thats why I say this:

The last thing I want to do is get in between any forum member, I hope you both respect that. Can someone direct me to a mod or have a mod directed here?

agreed. Next time seller should note that if a pm come first then the name is sold to the PM. In this case you never mentioned PMs, so either way, there will someone upset... As GD says below, it's up to you

i've been burned by the pm / post thing in the past as well, but considering that Dan never stated post or pm, I'd have to say the first to 'respond' would be the winner, just my $.02

Joe, let me clarify a few points:

1) The seller did not mention "Post SOLD to claim"
2) The seller did not mention "No PM" either

Thus, I would say that both "Post SOLD" or 'PM SOLD" are acceptable in this sale. IMHO, the decision should be hinged on which one came to the seller first.

I didnt know about either the post or the pm, until i logged on, and when i did log on, I saw the PM first.

I would not appear to throw a pissfit over a $4 domain, if I didn't actually want it.

And by posting SOLD first, I claimed it first.

Any other option is unacceptable and negative feedback WILL be left if the seller does not comply with the rules of fairplay. That's why I do business on DNF and not on NPros where amateur teenagers trade domains as a hobby.

Your post in unclear about posting sold, first to contact you saying they'd buy it should get it. It's up to you, it's your sale, we don't get involved.
