Google will have to put a lot into appealing this decision because this will be just the tip of the iceberg if they lose this. Losing means they will have to develop and maintain a database of all trademarked terms which advertisers will not be allowed to bid on. And apparently they will also have to include non-U.S. trademarks. Sounds like a real can of worms but Google definitely has the resources to handle it. Of course all of the major PPCSEs will need to follow suit.

I am also wondering if this insanity will be carried over to their organic search results?

Google will figure this all out. How about charging trademark holders a flat fee of $3 per click? If they don't want to pay just don't display anything for the trademark - PPC or organic. Nothing.

I bet silence would really get TM companies attention.

It has in the past I believe. Haven't you ever received results from Google where is says that due to the DMCA certain results weren't listed?
