Hehe, no, not out of the blue, he was referred to me by the attorney you referenced in the trademark thread (good information, thanks, glad to know that).

I don't believe he gave me a state, just quoted me an outrageous rate without knowing much, basically no more than what you know.

Do you do trademark infringement cases, John?

[btw, I once had an attorney offer to handle a copyright infringement case for me and wanted adult videos in payment. Is that allowed? :)]

Not sure if it's allowed, but it would certainly confirm some attorney stereotypes.

After I wrote this, I got to thinking - what do legal fees equate to in exchange for porno's?

Attorneys and clients can certainly agree to a variety of fee arrangements. My only question would be whether the adult videos proposed to be used as payment constituted the copyrighted subject matter of the dispute, that could raise an issue of whether the attorney has impermissibly taken an interest in the subject matter.

By an amazing coincidence, I actually had a copyright client offer me free access to pornographic websites in partial payment of a matter I had handled for them. I declined that offer. One might assume that other attorneys would base this sort of fee on the quality and quantity of the screwing provided compared to the screwing received.

The videos had nothing to do with the infringement. I had a unique product and he wanted it! He's the 2nd one to ask for videos instead of payment. The latter screwed up a case I had, though, so I am out the two grand he should have gotten back for me plus the videos (he claims he filed a court case on my behalf yet I've seen no paperwork, and claims I won a judgment but I've seen no paperwork, and the company has since gone out of business, though when I won, they were still in business. He just didn't make my case a priority and let it lapse).

I will email you about the trademark infringement since you're a little familiar with my problem.

Update:

RegisterFly.com has for now given me back my domain! If the other party tries to pursue legally then I'm sure it will go back into dispute. The other party (thief) responded to their emails and threatened legal action so I wasn't sure if my evidence would carry enough weight.

I appreciate all the support. Information at another forum allowed me to show RegFly a link where the individual who stole icecreams.com was running a paypal scam using the same email address as he used to steal my domain. I think this information helped along with all my documentation to pursuade them to put the name in my account.

Puravida, I am very sorry to hear about your luck. Hopefully things are brighter now.

I am definately learning alot this year about the sale and theft of domains. In hindsight I definately am wary of significant sales by anything other than Escrow unless I've dealt with the individual before. I guess I just got use to people being honest and let my guard down.
