(moderator: I posted this already mistakenly in the legal forum. Can you delete that dup thread please?)

I would like to start an online magazine with the name [keyword]today.com. I cannot find any publication with that name via searching. None of the other major tld's are registered.

I searched the US trademarks and there is one filing with that name, but it is DEAD, and ABANDONED in 1991. And it is for class IC 042. US 100. G & S.

The filing company was called [keyword] Today Corporation, in Florida. However, a google search does not find any such company.

Do you believe I would be safe in starting this site, and applying for registration with my mark?

Does the trademark examiner ignore dead, abandoned filings as if they do not exist?
