well.. I know icq.com is active and famous.. but well, what can I say.. I think there would be TM issues on NORTH.ca even.. who knows!!! It's a matter of time, till a C&D to arrive for both I presume!!!

That doesn't mean it's a TM issue. Unless you use it in order to profit from the ICQ brand, there's no issue.

Well, I thought it was the 3 char and could be used in many different ways. Something to do with Quebec.

But, NORTH will have to be marketed so well, one needs to have a huge marketing budget.

its value is based on the icq brand and I think there should be significant type in traffic.

I would surmise it does get ok traffic, but what clicks it gets probably pay poorly. Not the highest paying niche to say the least. icq.com also dominates the entire first page of google.ca so getting it listed there under "icq" will be tough, and trying to ride their coattails to it might bring other problems.

Someone will buy it, park it and realize they paid too much.

North.ca on the other hand can be used for so many different things making it highly desirable to so many end-users. :eek:k:

ICQ is actually Trademarked in Canada and owned by AOL - ie Time Warner (billion dollar company)

Cira Dispute resolution recently concluded that even a site that does not directly compete with a TM holder can be seem as a "competitor". Not for the product or service, but a "competitor" for web traffic. This precedent is dangerous, and would be used here, so even if you launched a site about "Ice Castles in Quebec"... icq.ca would be competing for traffic with ICQ.com and therefore likely to lose the domain.
