From today, SMS and Email marketing requires explicit consent in the UK. Email marketing now must have disclosure [in the subject line] to identify immediately and with clarity, without the need for opening the email, that it is an advertisment.

Popup adverts are also affected! Horray!

They seem to have removed the news item (bizzare) from their website, however I had the page cahced on my computer - and here is the relevant snippet:

http://www.asa.org.uk/news/show_news.asp?news_id=121&news_section=general
These changes include:

'Soft opt-in' for SMS and e-mail

Explicit consent is now required for marketing by e-mail or SMS unless marketers are offering similar products to existing.
Immediate disclosure if e-mails contain direct marketing

Legitimate unsolicited e-mail marketing communications must now be clearly identifiable as such without the need for recipients to open them.

Clarification of what new media is in and what is out

The CAP Code covers amongst others, online banner ads and pop-ups, moving image posters, SMS and marketing e-mails. The CAP Code does not cover companies' own claims on their websites.
