According to a recent report by domain name research think-tank AS-WIPO (Association of Servers of World Intellectual Property Owners), nine out of ten domain names sold or traded daily have a potential WIPO or TM case waiting to happen. An example of this enormous liability all of us domaintraders may be carrying is the recent AS-WIPO case of <fatbitch.com>. The one-member AS-WIPO review panel decided that the name was to be transfered to a complainant from Philadelphia who filed a case claiming "my family has always called me "fat bitch" as have all of my neighbors, and even my children's friends at school and their parents too. There may be other fat bitches out there but I am the only FAT BITCH period-end".
The respondent's defense (that "fat bitch" is a generic term and could not be claimed ownership of) was overuled given overwhelming evidence presented by the complainant supporting "bad faith" from the part of the respondent: "the <respondent> has failed to establish, portray, imply or depict on the website in question <fatbitch.com> a fat bitch as bad and mean as <the complainant> and thus is in bad faith of the extent of badness and actual magnitude of fatness and bitchdom".
In the decision statement awarding ownership to the complainant, the panelist stated: "In all fairness, "fat bitches" may be an apparently generic term used to denote irritable large sized women, but "fat bitch" is clearly an expletive owned by the complainant". The panelist also stated "the actual physiological weight of the complainant is irrelevant as no state or federal regulatory statutes currently exist regarding physical weight requirements in owning intellectual right to a domain name".
Blatantly rubbing it in, the victorious complainant said in an interview to the DomainNameJourney (DNJourney.com): "it was a typical Saturday night. I was watching the late HBO2 movie and my youngest son was surfing the net for porn. When I heard him scream MOMMA, SUM F**KER HAS STOLE YER HANDEL, I knew I had to act... where is this world coming to!?"
Detailed investigation into the case file revealed that early in the review process, the respondent presented as counter evidence an alleged email form the complainant's son containing original correspondence stating: WE 'R GONNA WIP YER AS*". The alleged email which was sent from the compainant's AOL account could not be verified as authentic during the review process because the complainant's son stated "I give out mom's AOL password in sex chatrooms all the time for favors". He added "we originally were going to call mom fatAs*hole. We might 've had to go up against Orson Wells or Marlon Brando."
