What would you do with Utube .com ?

if the utube.com domain was registered before the youtube.com trademark(and even without a TM on utube), and as long as their content does not infringe youtube's copyrights and TMs, youtube.com should not be able to get ahold of UTUBE.COM domain(using legal pathways).
