Seriously, If i reg a TM name of a US company would not really make free from lawsuit especially if the company is an international one such as Adobe, Intel, Microsoft. These companies have offices in the Philippines, and they're active in running after software pirates. So it's also possible that they could do this in trademark issues.

Heck, I don't even think the Middle East would be safe, what with all those soldiers running around. They probably think, Hrm, $1,500 + lawyer time for an UDRP case or $1,000 for one of the many mercenaries over there just looking for excuses to shoot people.

Speaking of, just had an idiot who claimed to be from Iraq (but with an IP based out of New York or something) offering me an insultingly low amount of money (less than the cost to register the name for one year back in '96 or '97 when I first got it) for a one word dictionary dot com that very clearly was listed for a minimum of five digits on the page that they found my email on... What's wrong with these people?

I just won (at namewinner) an .com domain that corresponds to the name of an italian company - est. 1914. They own a stupid .it variation of their own name. I have contacted them as I don't think they've TMed in the US.

I'll let you know what happens. Worst case scenario - I'm $30 in the red :)

This domainer phobia has to end.
1) do NOT reg TM names
2) If u did so not knowing that u did or believe it is questionable, stop being afraid.
I am sick and tired of having fellow friends 'abused' because they are bullied.
I own a super duper high end OLYMPIC domain name and the IOC knows because of certain facts they cant touch me. Just 1 example.
I never got the name to make money. Sure, I wanted to sell it to the right user to expose their dirty tacticts.
NOW??

That imbecile, the IOC president that has his position because of MY nations history is going to hear it LOUD and CLEAR. and not he wil speak as the Guru in Star Wars would say.

Great advice, there are members of this forum who have been sued by corporations for five figure amounts (due to cybersquatting) and you are advising them to be careful? Sure you can reg a TM name like "namebay.com" and run a registrar but blatant cybersquatting is asking for trouble.

I've actually never run into this problem. The only domain I've ever had (which failed miserably and I let drop after the year) is still indexed on google, and is surprisingly the only result for it. The domain was geekheadz.net and if you google for "geekheadz" it's still the one and only result. Crazy stuff right there.

Very funny - virtualy every word is trademarked - so exactly how do you NOT reg domains that can be confused with TM names?

I thin obvious TMS from not so obvious ones can be distinguished by most of us.

I always say "virtually" because some smartass (like yourself) is likely to come up with a word that I will have to spend hours checking a hundred trademark offices to find (guess my reply).

Even UN WIPO will not guarantee domain free from trademark - going through all their sources.

I also say most words are/can be used by many businesses in different goods or services (pick that one apart).

Many use the word "Bay" for example - so please explain why nobody can register "bay" domains.

Also - please show in UDRP or ACPA where only obvious trademarks are taken.

A very old list of words taken by WIPO I collected, include: video net, roller blade, best locks, nitro fuel, tonsil, north face, marketing mix, 0xygen, edentist, state-farm, new-gig, video direct, iphones, open mail, traditions, open view, unicode, southern company, pc gateway, ultra pure water, time keeper, click here, current, beauty co, sound-choice, e-auto-parts, eresolution, body and soul, talk about, esquire, office specialists, crew, praline, the total package, faith net, buy PC, home interiors, big dog, euro consult, music web, RANT...etc.
