Now I'm being threatened with legal action by buyer #1 because I won't send her the file because I don't want to be sued by buyer #2 if she posts the key generator somewhere.

I've been slandered and threatened...time for the gloves to come off and I think it's time for the suits to get invloved on my side. I have documented all emails and PMs from both parties and I have screenshots of this thread and the original thread for possible legal action.

Let's clean this mess up and be civil.

I bought the domain from topnames. He promptly transferred control of the site to me and sent me all files and instructions.

During that same time I got an offer from clicknow.to for 1.5X the price. I could not resist this offer. So I agreed to flip the site to him.

The site is a very simple site. There are a few php pages, the software which consists of a couple files and a keygen. It turns out there was no source. I asked topnames if there was any source included. He said no. That was that.

clicknow and I agreed to use escrow.com and once the money was received I transferred the domain to him and emailed him all the emails and files I had received from topnames.

clicknow emailed me that the keygen did not work. I tried it. It did not work. I emailed topnames and asked him nicely for a working keygen. This was after I had already told him I flipped it.

The actions that followed have got us to this point. So now we are at the point where even though the escow.com escow has not closed, topnames has refused to send me the original buyer the keygen, so I can send it on to clicknow. He says I am no longer the owner yet the escrow.com escrow has not closed. I may yet end up with a site that I can not use.

All I can say is that clicknow is a stand up guy and has been a pleasure to deal with. All I wanted was to get the "working" and "complete" site from topnames and pass that to clicknow as smoothly as possible. It was and is my responsibility to pass those files to clicknow. I have completely failed in this regard and don't know what to do. If the auction falls though I will have nothing as topnames has referred me to his attorney.

He has said he has a working copy now. If he agrees that I can send you the file...I will send you the file...it's that simple. Without his consent, I can not release the key gen. As for a complete site, you sold a site without testing it. If you tested the software when you bought the site, we could have avoided all this mess. I missed one .dat file which has been sent to clickto and he has acknowledged that. There is no reason for him to cancel the escrow transaction and he said how "great" you were and you say how "great" he is...so...it's a love fest.

Ken, sounds like you are still in the right, these 2 are obviously PM'ing each other trying to work together to bring you down. This was dogstars fault for reselling the site before he knew it worked. This is his fault, back away from it Ken, and if they are stupid enough to take legal action, you can shoot them down

Honestly dude, thanks. Thanks for taking this dispute public when all you had to do was attach a dat file to an email. Thanks for bringing up the word 'attorney' every time I sent you an email you didn't like. Thanks for showing your true colors in that last post, dripping with resentment:

"There is no reason for him to cancel the escrow transaction and he said how "great" you were and you say how "great" he is...so...it's a love fest."

Thanks for the memories and recording this for future buyers to be wary of.

I didn't take it public...the initinal post did not mention amyones name. I was asking for advice.

I think I showed my true colors by not selling the site to someone else at a higher price even though we had a deal. I've been on these forums for more than 2 years...people know what kind of person I am.

I'll make this real simple...I'll refund DogStars money and keep the site if Clickto dosen't want it. The site makes money....I should have kept it anyway.

That has happened to me already at 2 of the forum boards. After I paid good money for the ownership rights to a software program a short time later links were posted for its free use by anyone, (making sales real difficult and my purchase of the code a bad investment) by a few earlier retail level buyers.

Ouch.

I hate selling sites.. so easy for complications
Buying as well. It can be such a mess :-(

Wow, that is a heck of an offer.

Dogstar, good you could make it to the boards, it helped clear up a few things.

Since I have never done business with any of you, I can personally look at this in a different perspective.

Dogstar seen a site he liked, bought it, and instantly had an offer of 1.5 times his purchase price. What a great deal. I have been there before. That is quick cash, and we all wish it was that easy, absolutely nothing wrong with it, BUT, the mistake lies in the fact that there was a problem with the program.....

A lesson hopefully learned. If you buy a site, and go to resell it, make sure everything works! Even if it doesn't at least you know it, and you can transfer the knowledge over to the new owner.

I see no reason or grounds for legal action. It really appears that this can all be resolved. No one says that you guys/gals ever have to deal with each other again.

You all should actually steer clear of each other :)

Hopefully this doesn't put a bad taste in the selling community. I have sold over 129 websites in the last 5 years, and have never run into a problem like this. Sure you will have your occasional altercation, mostly because of a misunderstanding, but I, just like many other's here, do this for a living. When you do this kind of business for a living, your word is about all you got. Once people don't trust you, you are out of business.

If anybody has a legit complaint, it is clicknow, since he is the one currently who has the money on the line. I think you can all work togther to have a resolution.

At the same time, I see no reason to bash TopNames either. He is the only one here that is going out of his way, even tho all of you have a rightful complaint in one way or another.

Like I said, if there is anything I can do to help you all out (besides give out money..lol), lemme know!

all I can say is, dogstar made an offer for my site and there is no way in hell I would ever want to deal with him now...

Ken, on the other hand, I would be privilaged to work with...

dogstar: you and clickto messed this up, if you hadn't been so ignorant, you would have been able to get it worked out quickly and quietly. Then being such a jerk just made things worse for you....grow up...

Actually I would do business with clicknow again in a second. After surviving this transaction, he should be sainted. I doubt he would ever do business with me though because I did make a terrible mistake.

I disagree...you worked hard emailing me trying to resolve the issue and he should be happy because I resolved the issue as soon as I got home from work. It didn't take weeks or days...it took only a few hours. I wish I could have all my tech support issues resolved in a few hours.

Like I said...I'll buy the site back if no one wants it. It made more than $250 in less than a month and all I did was link it on TopNames. The offer stands for 24 hours.

Well, he was really bummed because he had an order he had to refund. I tried to help him out. I even ran filemon and figured out that the data.dat file was missing.

I wish to end this feud because I think in a week or so it will not be such a big thing. I think tempers have flared and people will be sore for a while, but then everyone in the end will have what they wanted.

But by taking this public what was the cost? If I just sold a site three forums up a few days ago and then post a 'need advise on bad web sale' it is effectively telling the public because users will figure it out. That's just not right for something that could and should have been resolved privately.

Now GTweb will not do business with me. And I pride myself on sending payments right away. I did so for you topnames, didn't I? Without worry at all. And you handled the transaction so so well then. This seemed like a minor glitch that exploded for no reason. I don't get it. Oh well.

A $9.99 refund should not be the end of the world...but I had not be contacted at that point. I was contacted after the key gen problem was discovered.

Like I said, I didn't take it public. I didn't mention anyone's name until clickto identified himself. I just asked for advice...that was it.

Being in the middle of things when they go wrong can be a nightmare. There seemed to be no way for me to fix it. The train just derailed...

I told my wife that this would be the easiest $500 bucks I ever made. Boy oh boy was I wrong.
