You should go kick their asses for even trying to take it...in need of a good ole' knuckle sandwich imo! This win was a no brainer, and you had no chance of loosing with John B. on the case! Congrats! ...Again!

It's like a safari of the Internet where would be legal loophole hijackers try to get all of Adam Dicker's great generic animal .com's! But they were shooting blanks! lol :eek:k:

Adam, seriously...were you just a little worried?

Seems people like chasing my barnyard critters.

Elephant in a barnyard?

Sounds like he tried to get it for nothing and when that didnt work, he tried to hijack it using WIPO, does anyone know if the Complainant is responsible for the Respondents attorney fees?....just curious.

the Respondent has been engaged in a pattern of domain registration, including other animal domain names as <elephant.com>, <worm.com>, <seals.com>, and <giraffes.com>.

Did you offer this information to their lawyers?

Pig .com Minimum offer: 400,000.00

As good as elephant @ 800k imo.

At page 2 of the Complainant’s supplement, the Complainant hypothesizes that an Internet user visiting <pig.com> would expect to find information relating to “swine or pork.” The Respondent agrees. If the Complainant were to obtain the domain name, then no Internet user looking for swine or pork is going to find it at <pig.com>.
Excellent!

I don't know whether to laugh or be appalled.
Appalled ... yes! Someone would have to be devoid of a conscience to attempt to steal a generic like "pig", or pompous and ill-informed.

The Panel finds that Respondent registered the <pig.com> domain name based on the dictionary meaning of the term “pig” and not to take advantage of Complainant’s generic mark.
Simple, undeniable logic. Justice would be the imposition of a $50,000 penalty for wasting everyone's time ... or the permanent revocation of their stupid trademark.

Good for Adam and John for exposing this company's stupidity and greed. Where's the reverse hijacking finding?

Yay! Congrats:

This little piggy registered a .com
That little piggy stayed home
That little piggy sued this little piggy
And that little piggy ended up with none!

I love the jokes in this thread!

One comment in the case which raised my brow "It has been repeatedly held that pay per click sites are not a legitimate use of a domain name"

Is this a fact ?

Congrats on the decision Adam!

Adam,

I know you paid for more judges + you have attorney fees, is all this money out of pocket? or will you reimbursed by the losing party?

It's been held both ways. This is the complainant's lawyer trying to make their case. I believe that it has also been held to be a legitimate use - as happened implicitly in this case.
