im not part of any scam im just a interested domain buyer if these guys scammed someone they will be in trouble i dont have anything to do with that many people buy domains of course on the web and domainp is new so we never know who the heck we are buying from in the first place.

atillo has the domain and he isn't going to give it to you just because you paid domainp $3000. You are out 3 G's that you will never see again and you don't have ouch.com either!

I don't have time to sort this thread out, so let me see if I followed the allegations correctly.

1. Party A had the domain name.

2. The domain name was bought by party B.

3. Party A alleges it was not paid by party B.

4. Party B's friend offered the domain name for sale here.

5. Party C agreed to buy it and has received transfer of the domain name.

6. Party C has not yet paid Party B's friend because of the allegation of Party A.

Is that where we are?

Party A won the name at godaddy during the drop.
Party A placed it for sale on ebay
Party A sold it to party B
Party A transferred to party B before the echeck had cleared
Party B cancelled the echeck and immediately sold it to party C
Party C put it for sale at ebay and here and sold it to party D
Party C is in Russia so he wanted Western Union
Party D received the domain into his godaddy account however he found out that party B never paid for the domain. Thinking party B and C were one and the same he elected not to send payment immediately as party A contacted party D through the grapevine and showed Party D the cancelled echeck receipt and the godaddy receipt for catching the name during the drop.
Now Party C is claiming he was defrauded by his friend and has resold it within the last few hours to party E who just wanted the name and doesn't really care that it was fraudulently obtained.

Whew! That's where we're at.

BTW party E what did you pay for the name? Why would you purchase a domain which has serious issues after reading the postings from the 2 Attorneys?

atillo has to transfer the domain to me its paid for and if a problem occurs in the future it will be given back to the original owner as long as i get my 3k

jh3 you have to much drama and hype i been doing domain business since 1997 and sold a top name to gregr owner of the site i never was part of any scam you are really looking for a soap opera arent ya you must be new.

1. The fact that Party B cancelled an echeck teaches (under the UCC and Restatement) that the title held by Party B is voidable, not void.

2. We do not know if Party C was a BFP. Question of fact.

3. Party D certainly cannot be a BFP since he now knows there is an issue and, in fact, has not paid for the domain.

So, Party A takes the domain from Party D, assuming Party A can prove that Party C was not a BFP (and assuming, as Phily pointed out, that the UCC applies. But we are just pontificating here and I'm sure we lawyers don't really want to rub each other's noses in it our foibles; nicer to praise the fortes.)
