Why would you waste legal fees, and try to sue them all the way from Australia. Simply have your CC charges refunded through the CC company, and let it go.
Alarming news about RegFly, as I've never had a problem with them in a couple of years (knock on wood).
BTW, if a eNom registrar goes under, what happens to the domains - I guess you just manage them through the eNom control panel? Does anyone here know, or has anyone faced this issue yet?
