I was in a WIPO case for the last few months over elephant.com with admiral insurance and the claimed they had rights to elephant.com as their main site is elephant.co.uk.

This case was decided by a panel today and the decision is:

The complaint is denied.

The case results will be posted Monday.

Excellent work. That would have been a huge blow to the domain community if it would have gone the other way. It would have encouraged other companies to try their luck at getting other generic names.

would apple have rights to apple.com? same argument but I guess apple computers was TMed a long time ago. shame if you can just buy a company name or TM and demand the .COM which is worth 10 or 100 times more.

elephant.co.uk is very big... IF they didn't wipo it i am sure DCG would have accepted a nice juicy offer from them... DCG after the wipo would you still sell it to them?

This is the problem now... once companies wipo a domain... AND lose how can they expect to actually offer to buy it if they really need it!

Elephant.co.uk is contantly in tv's in the uk and most people NEVER type in .co.uk lol everyone just types .com!

My guess is elephant.com gets a hell of alot of the .co.uk users.

But i can't see ANY way a company can call themselfs after an animal and trademark it to take the domain via wipo... ANY animal names or human names would probably lose a wipo!

Good News for Both DCG and John. Just another waste of money for Elephant.co.uk (with their pathetic ads)

elephant.com ovt with ext 4107, most get amazing traffic.

Well done.

The only way they would have had any chance of being "entitled" to the domain via WIPO, would be if the domain was being used in bad faith. "We all know" that it isn't sufficient for the domain just to be the same as or confusingly similar to a trade mark.
